Another example of Homeland inSecurity run amok! As others point out, photography from a public venue such as a sidewalk or public street is certainly off the property and the RR Polizei cannot interfere.
A friend was accosted by a former CNW cop assigned to the Twin Cities. Jerry was on a public sidewalk across from the CNW yard and did not even have his camera to his eye - it was merely hanging off his shoulder. "SuperCop" (as was his nickname to those of us in Iowa and Minnesota) made a U turn and pretty much threw my bud onto the hood of the car when Jerry said since he was on a public sidewalk he was not under any form of rules or orders by SuperCop to leave. In fact, Jerry told him to call the South St Paul Police if he felt there was a problem.
St Paul uniforms show up, hear the stories and tell Jerry to be on his way - after berating SuperCop to NOT harass citizens on public sidewalks who were doing nothing. My friend decided any photos were not worth arguing about free assembly, rights guaranteed in the Constitution.
This was a decade ago. One reason I quit railfanning in populated areas. I prefer to go to the boonies when I feel like breaking the "law" according to Homeland inSecurity.. ......... have seen no problems in central Missouri.

I don't have any problems down here either. I had a couple run-ins with a rookie cop who thought he was God and found himself in the unemployment line after I got finished with him.
Cops see me by the track all the time and keep on going, and I'm sitting right at trackside.
